Terms & Conditions

1. Introduction

 

1.1 Acceptance of Terms

By accessing or using InsideOut Moving’s services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and InsideOut Moving Inc. (“Company,” “we,” “us,” or “our”).

1.2 Modification of Terms

InsideOut Moving reserves the right to modify these Terms at any time. Modifications will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the amended Terms, you must stop using our services.

1.3 Definitions

• Company: InsideOut Moving Inc.

• Client: The individual or entity booking services.

• Services: Moving, packing, and relocation services provided by InsideOut Moving.

• User: Any person accessing our website or services.

• Agreement: These Terms and Conditions, including any amendments or modifications.

 

2. Description of Services

2.1 Types of Services

InsideOut Moving offers a range of services, including but not limited to:

• Residential Moves

• Corporate and Office Relocations

• Long-Distance Moves

• Packing and Unpacking Services

• Specialty Item Handling (e.g., pianos, antiques)

 

2.2 Service Areas

Our services are available in specific geographical areas as listed on our website. Service availability may vary based on location and service type. We strive to expand our service areas and keep clients informed of any changes.

2.3 Service Limitations

All services are subject to availability and may be modified or discontinued at any time. We reserve the right to refuse service to anyone for any reason. Service limitations may include, but are not limited to, maximum capacity, building restrictions, and legal requirements.

 

2.4 Customization and Special Requests

Clients may request customized services tailored to their specific moving needs. Special requests, including handling delicate or oversized items, must be made at least 72 hours prior to the move date and may incur additional charges.

 

2.5 Equipment and Supplies

InsideOut Moving provides necessary equipment and supplies for safe moving, including dollies, padding, and securing materials. Clients are responsible for preparing access to the location(s) and ensuring any building or community requirements are met.

2.6 Staff

Our professional movers are trained to provide efficient and courteous service. All staff members adhere to our code of conduct and undergo background checks to ensure client safety and service quality.

 

3. Eligibility

 

3.1 Legal Authority

You must have the legal authority to enter into this agreement. By booking our services, you confirm that you have the legal right and capacity to enter into these Terms. This includes ensuring compliance with local, provincial, and federal laws and regulations relevant to your move.

 

3.2 Representation and Warranties

You represent and warrant that:

• All information you provide is accurate, complete, and current.

• You will comply with all applicable laws and regulations.

• You have obtained all necessary permissions, licenses, and consents to facilitate the move.

 

4. Bookings and Payments

 

4.1 Booking Process

To book our services, complete the booking form on our website and pay a non-refundable deposit. Bookings are confirmed only after the deposit is received.

 

4.2 Payment Methods

We accept credit cards, debit cards, and electronic transfers. Card and cheque payments are subject to HST (13%).

 

4.3 Pricing and Fees

Prices for InsideOut Moving’s services are subject to change without prior notice. However, prices confirmed at the time of booking will be honored and will not be subject to subsequent rate increases. Our standard moving packages cover services within a specified set of hours as outlined in your booking confirmation.

 

If the move extends beyond these agreed hours, any additional hours will be billed at the agreed-upon hourly rate. The hourly rate for additional hours will be communicated at the time of booking or upon request, ensuring complete transparency in pricing. Additional services or requests—such as handling specialty items, extra stops, or extended labor needs—may incur extra charges. 4.4 Payment Terms

The remaining balance is due 14 days before the move date. Failure to make timely payments may result in cancellation. Payment plans may be available upon request and approval.

 

4.5 Late Payments

Late payments incur interest on the overdue amount at 1.5% per month or the maximum rate permitted by law.

 

4.6 Refund Policy

Refunds are processed per our cancellation policy. Non-refundable deposits will not be returned. Refund requests must be in writing and are processed within 72 hours.

 

4.7 Rescheduling Policy

Clients may request to reschedule at least 72 hours prior. Rescheduling is subject to availability and may incur fees.

 

5. Cancellations and Refunds

 

5.1 Client Cancellations

• More than 30 Days Before Move: Client cancellations made more than 30 days before the scheduled move do not result in a refund, and the deposit will be forfeited to InsideOut Moving.

• Less than 30 Days Before Move: Cancellations made within 30 days of the scheduled move are non-refundable, and the deposit will be forfeited to InsideOut Moving.

5.2 Company Cancellations

InsideOut Moving reserves the right to cancel services in the event of unforeseen circumstances beyond our control, such as severe weather, natural disasters, emergencies, or other situations that may pose safety risks to our staff or clients. In such cases, we will make every reasonable effort to inform clients as soon as possible and to reschedule services to a mutually agreeable date, subject to availability.

 

If rescheduling is not feasible, a full refund will be issued for the cancelled services. However, InsideOut Moving shall not be held liable for any damages, inconvenience, or losses incurred by the client due to cancellation, rescheduling, or delay arising from such unforeseen circumstances. Our liability is limited solely to the refund of payments made for the scheduled services.

 

5.3 Refund Process

Refunds are processed within 30 days and issued to the original payment method.

 

5.4 Rescheduling

Clients may reschedule the move date at least 72 hours in advance, subject to availability and possible additional fees.

 

5.5 No-Show Policy

If the client fails to show up without prior notice, no refund is issued, and the full booking amount is charged.

 

5.6 Partial Cancellations

Clients wishing to cancel part of the services (e.g., add-ons) must provide written notice 72 hours prior. Partial cancellations may adjust the booking cost and are subject to approval.

 

5.7 Force Majeure

Neither party shall be liable for failure to perform if due to uncontrollable events, such as natural disasters or government actions.

 

6. Liability and Insurance

 

6.1 Limited Liability

InsideOut Moving takes every precaution to ensure the safety of your belongings and property; however, we shall not be held liable for any direct, indirect, incidental, or consequential damages to personal property, premises, or belongings under any circumstances. This includes damages resulting from, but not limited to:

• Improper packing of items by the client

• Items packed by InsideOut Moving, as all packing is undertaken at the client’s own risk

• Normal wear and tear associated with the moving process

• Structural limitations within the property (e.g., narrow staircases, tight hallways, floor types)

• Circumstances beyond our control, such as traffic, weather conditions, natural disasters, or accidents

 

For items of extraordinary value, specifically those with an individual value exceeding $10,000.00 CAD, it is required that clients purchase adequate insurance prior to the move. InsideOut Moving holds no obligation to provide or arrange insurance for these items, and clients are solely responsible for inquiring about and purchasing any necessary coverage through their own means.

Clients are also responsible for ensuring that their premises and belongings are prepared and protected before the move. InsideOut Moving’s liability, in any instance of dispute, is strictly limited to the amount paid for services rendered within the six months preceding the claim. Under no circumstances shall InsideOut Moving be liable for indirect costs, inconvenience, loss of use, emotional distress, or other incidental damages related to property or item damage during the move.

 

6.2 Insurance Coverage

InsideOut Moving maintains general liability insurance coverage of up to $5 million to safeguard our clients and operations. For clients seeking additional insurance for high-value or specialty items, third-party insurance options may be available upon request. This additional insurance is facilitated through independent third-party insurers, and InsideOut Moving holds no responsibility for the obligations, performance, or terms of any third-party insurance provider.

 

All sales of additional insurance, including coverage for “insured moves” or “insured specialty items,” are processed exclusively by these third-party entities. Clients are encouraged to carefully review and understand the terms of any third-party policy they purchase, as InsideOut Moving does not manage or bear responsibility for the claims, limitations, or conditions stipulated by external insurers. InsideOut Moving’s general liability insurance serves as our primary coverage for general operational liability only and does not extend to individual items unless specified by the third-party insurer.

 

7. Intellectual Property

 

7.1 Ownership

All content, trademarks, and data on our website, including software, text, graphics, icons, designs, and agreements, are the property of or licensed to InsideOut Moving and are protected by law.

 

7.2 Use of Intellectual Property

Unauthorized use of logos, icons, or trademarks from the website is prohibited. Written consent is required for any other use.

 

7.3 User-Generated Content

If you submit content, including reviews or comments, you grant InsideOut Moving a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display such content worldwide.

 

7.4 Infringement Claims

If you believe your intellectual property rights have been infringed, contact us with a detailed description of the alleged infringement. We will investigate and take appropriate action.

 

8. Prohibited Conduct

 

8.1 User Conduct

You agree not to use the services for unlawful purposes or any purpose prohibited under this clause. You agree not to use the services in ways that could damage the services or business of InsideOut Moving.

 

8.2 Prohibited Activities

Prohibited uses include, but are not limited to:

• Harassment, abuse, or threatening behavior.

• Intellectual property infringement.

• Uploading harmful software.

• Fraudulent activity or false information.

• Publishing obscene or defamatory content.

 

8.3 Consequences of Violations

Violations may result in account suspension, termination, and/or legal action as deemed necessary by InsideOut Moving.

 

9. Dispute Resolution

 

9.1 Governing Law

These Terms are governed by the laws of the jurisdiction where InsideOut Moving operates. Disputes are subject to the exclusive jurisdiction of the courts in that jurisdiction.

 

9.2 Arbitration

Disputes arising from these Terms shall be resolved through binding arbitration according to The International Centre for Dispute Resolution Canada rules in the province where InsideOut Moving operates.

9.3 Legal Expenses

In legal actions, the prevailing party may recover its costs and reasonable attorneys’ fees.

 

9.4 Class Action Waiver

Disputes shall be conducted on an individual basis, and you waive your right to participate in class action lawsuits or class-wide arbitration.

 

10. Termination

 

10.1 Termination by Client

Clients may terminate services by written notice. Termination does not entitle the client to a refund of payments made.

 

10.2 Termination by Company

InsideOut Moving may terminate services immediately, without prior notice, for any breach of the Terms.

 

10.3 Effects of Termination

Upon termination, the client’s right to use services ceases immediately. Provisions like ownership, liability disclaimers, and indemnity survive termination.

 

11. Notices

 

11.1 Giving Notice

All notices shall be in writing and deemed delivered when sent by hand, email (with acknowledgment), or recognized overnight delivery service.

11.2 When Notice is Deemed Given

Notices are deemed given on the date of delivery, receipt of email, or as shown in records for overnight delivery.

13. Miscellaneous

 

13.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

 

13.2 Entire Agreement

These Terms constitute the entire agreement between you and InsideOut Moving and supersede any prior agreements.

 

13.3 No Waiver

The failure of InsideOut Moving to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign these Terms without InsideOut Moving’s written consent. InsideOut Moving may assign or transfer these Terms at its discretion.

 

13.5 Force Majeure

InsideOut Moving is not liable for delays or failures to perform due to events beyond its control, including natural disasters, acts of war, government restrictions, or other unforeseen events.

 

13.6 Relationship of Parties

You and InsideOut Moving are independent contractors. These Terms do not create a partnership, joint venture, agency, or employment relationship between you and InsideOut Moving.

13.7 Headings

Headings are for convenience only and do not affect interpretation.

 

13.8 Language

These Terms are provided in English. In case of translation, the English version shall prevail.
